1、美国EB3移民第一类，“技术工人”的要求：

（1）You must be able to demonstrate at least 2 years of job experience or training。

你必须能证明至少有2年工作或者培训经验。

（2）You must be performing work for which qualified workers are not available in the United States。

你必须胜任该工作，且在美国本土无法聘请到这样的工人。

2、美国EB3移民第二类，“专业人才”的要求：

（1）You must be able to demonstrate that you possess a U.S. baccalaureate degree or foreign degree equivalent, and that a baccalaureate degree is the normal requirement for entry into the occupation.

你必须能只能证明你拥有一个美国的本科文凭或者国外同等学历，并且一个本科学历专业要与工作领域相符合。

（2）You must be performing work for which qualified workers are not available in the United States。

您必须能胜任专业的工人，且在美国本土无法聘请到这样的工人。

（3）Education and experience may not be substituted for a baccalaureate degree。

教育和经验不能被本科学历所替代。

3、美国EB3移民第三类，“其他工人”的要求：

You must be capable, at the time the petition is filed on your behalf, of performing unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature, for which qualified workers are not available in the United States.

当时代表你提出申请时，你必须是有能力胜任非技术工作的工人(需要不少于2年的培训或经验),并且不是一个临时的或季节性的工作，且在美国本土无法聘请到这样的工人。

注：以上三类均需要满足同样的条件：Labor certification and a permanent, full-time job offer required.即劳工认证和提供永久的全职工作。需要雇主申请劳工许可证和提供长期的、全职的工作承诺。

Note: While eligibility requirements for the third preference classification are less stringent, you should be aware that a long backlog exists for visas in the "other workers" category.

4、美国劳工部 - 劳工许可证U.S. Department of Labor – Labor Certification

Third preference petitions must generally be accompanied by an approved, individual labor certification from the Department of Labor on Form ETA-9089. In some cases, the petition may be submitted to U.S. Citizenship and Immigration Service (USCIS) with an uncertified ETA-9089 for consideration as Schedule A, Group I.
